MMC has vast expertise in litigation and alternative resolution of
disputes, of commercial nature. We offer Mediation and Arbitration
services, reaching the most professional and sound resolutions.
Under the leadership of Mr. Peter Munge Murage and the valued
assistance of Mr. C. S Maondo, MMC is providing arbitration
proceedings to several international and local corporate clients. As part
of our professional policy we encourage clients to invoke arbitration
clauses whenever contractual disputes arise, trying to avoid the delay
and losses caused by our judicial system.
Our Firm has built an outstanding reputation in Commercial Litigation.
We act on a regular basis for Banks, Oil and Gas multinational
corporations, conducting commercial arbitrations, complex suits and
tough negotiations.
Case in Point is the famous Mugoya Construction Company Limited
case, wherein MMC represented the Kenya Commercial Bank and
recovered a sum of KShs. 1.3 Billion! This is just one of many additional
prominent litigation cases. Currently we represent the multinational oil
corporations in the dispute for the award of a contract to inspect
imported fuel cargo.
Another field of action we specialize in is debt collection services. We
undertake debt collection assignments from diverse clients, such as
Banks and micro finance institutions. We have an internal debt collection
team of 4 members. These people are part of our firm's staff and they
operate under the direct supervision of our partner, Mr. Peter Munge
Murage. The internal debt collectors are experienced investigators who
are able to collect useful information on the debtors’ whereabouts and
financial standings. Collecting such information is highly useful in
determining future debt settlements, avoiding money loss. For the last
2 years MMC has been ranked by Barclays Bank of Kenya Limited Retail
consumer team as the leading firm in debt collection.
The Employment Act was repealed with the commencement of the
Employment Act, 2007, and the Labour Institutions Act, 2007, which
introduced radical changes in the law regarding employment. As a result
there has been a significant increase in the number of disputes in the
Industrial Court between employees and employers. Identifying this
process our firm has specialized in defending its corporate clients at the
Industrial Court, trying to reach our clients' objectives.
One of our Associate Partners - Mr. C S. Maondo, has vast experience
in employment disputes. Over the past years Mr. Maondo has acted for
many corporate clients, helping them win their cases. We also
consistently advise our corporate clients and undertake training
sessions for their Human Resource teams. Our purpose is to enlighten
them on the new provisions on employment Laws as stipulated in the
aforesaid statutes, thus reducing labour disputes.
MMC also specializes on public procurement disputes at the Public
Procurement Review Board, wherein we act for several local and
international clients. Mr. Peter Munge Murage is uniquely experienced
and qualified in this area, after representing many clients in the Review
Board and in the High Court.
